Applicants should note that the Scottish Government and associated public bodies are subject to the Freedom of Information (Scotland) Act 2002 and the Environmental Information (Scotland) Regulations 2004.
We must comply with those regimes and disclose information that we hold on request, unless an exemption or exception allows us to withhold it.
We can withhold information for a number of reasons, including where its disclosure would substantially prejudice commercial interests – although the prejudice needs to be weighed against the public interest in disclosure.
As a matter of good practice, we will seek your views on disclosing information that you have provided wherever possible.
We will consider your views carefully, although the final decision about disclosure in accordance with the legislation is for us.
