Animal Health Fixed Penalty Notice Scheme: Enforcement Guidance

Guidance for enforcement authorities on the animal health fixed penalty notice (FPN) scheme introduced by the Animal Health Fixed Penalty Notice (Scotland) Regulations 2026.


Record keeping

Enforcement authorities must keep records of:

  • the name and address of the person issued the FPN
  • the date of issue
  • the relevant requirement and relevant offence
  • the penalty level and whether the escalation process has been applied

The records must be kept for three years beginning on the date the FPN was issued. This is to ensure the escalation process for repeat offending can be applied.

The Scottish Government will request the following information from enforcement authorities relating to FPNs issued at the end of each calendar year:.

  • the total number of appeals received (including any that were withdrawn as a result of the appeal being upheld)
  • the total number of appeals rejected
  • information relating to the FPNs issued (date of issue, relevant requirement and offence, penalty level and whether the escalation process has been applied, total amount paid, and if the FPN was not paid, whether the case was referred to COPFS for consideration of prosecution)
