As set out, the powers that have been put in place allow for swift interventions to be made where it is required to do so. Due to the thresholds in place surrounding the circumstances of using these powers such as a serious or imminent risk to life, health or wellbeing or that of a service failure, the likelihood of the powers being used are rare. They are also additional to the processes which are currently in place, to be used in extreme scenarios. Therefore not all matters will be picked up in this advisory note.
