UK Supreme Court Judgment (For Women Scotland Ltd v The Scottish Ministers): working group
Overview
This group was established in April 2025. It is convened by the Permanent Secretary and is driving and coordinating the work that is necessary as a consequence of the Supreme Court judgment by reviewing and updating relevant legislation, guidance and policies impacted by the judgment.
Every key area of government which is or may be affected by the judgment is carrying out assessments to identify and resolve any inconsistencies with the ruling. Ongoing and completed work includes:
- the guidance for the Gender Representation on Public Boards (Scotland) Act 2018 has now been updated and published to reflect the judgment
- the Public Appointments Recruitment Process for regulated Public Bodies is being amended to reflect the Supreme Court ruling on the 2018 Act
- Stop and Search Code of Practice - Following our scoping exercise and joint working with Police Scotland, we will publicly consult on the Stop and Search Code of Practice later in 2025
- the Supporting Transgender Young People in Schools Guidance is being reviewed, recognising that the Equality and Human Rights Committee (EHRC) are also reviewing Technical Guidance for Schools
- meeting key stakeholder groups to discuss the judgment, as well as the EHRC, given their role as regulator and enforcer of the Equality Act 2010, and also the UK and Welsh Governments to ensure collective understanding of the practical implications of the judgment
