Complaints regarding A75 Newton Stewart from the roundabout with A714: EIR release

Information requested

 

1. The number of complaints about defects with the A75 at Newton Stewart from the roundabout with the A714 to west of the Hospital and the Barnkirk Road. Between August and December 2018, listed by date.

2. The road repairs made to the same section of road for the same period.  Listed by date.

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations.  We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA. 

This exemption is subject to the ‘public interest test’.  Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption.  We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes.  This is essentially a technical point and has no material effect on the outcome of your request.

 

1. We received a total of 7 complaints about defects on the A75 at Newton Stewart from the roundabout with the A714 to west of the Hospital and the Barnkirk Road between August and December 2018. The dates of these complaints are; 18/08/2018, 21/08/2018, 23/08/2018, 15/10/2018, 22/10/2018, 5/12/2018 and 20/12/2018.

 

2. The road repairs made to the same section of road for the same period took place on 5 to 6 September 2018 and 10 to 11 December 2018. These works were for resurfacing.
