Information requested

A list of who worked for the Scottish Child Abuse Inquiry on 5 May 2016. Information should include but not be limited to, Scottish Government employees who were seconded and which department they were seconded from, and on whose authorisation.

Response

I enclose some of the information you have requested at Annex A of this letter. We are unable to provide you with the remainder of the information you have requested because an exemption under section 38(1)(b) (personal data relating to a third party). The reason why this exemption applies is explained below.

Publicly available information which would have been available on Inquiry or Scottish Government's websites on 5 May 2016:

  • Chair – Susan O'Brien QC – Appointed by Scottish Government Ministers as per Section 4(1) of the Inquiries Act 2005.

  • Panel Members – Michael Lamb and Glenn Houston – appointed by Scottish Government Ministers as per Section 4(1) of the Inquiries Act 2005.

  • Counsel to the Inquiry – Colin MacAulay QC, James Peoples QC, John Halley, Advocate – Appointed by the Chair, Susan O'Brien.

  • Julie-Anne Jamieson – Secretary to the Inquiry.

  • Andrea Summers – Solicitor to the Inquiry.

Reasons for not providing information

An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of a third party, ie names of individuals and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
