Mental Health Law - Official Reviews

In Scotland, our legislation promotes patients’ rights and provides safeguards.  The Mental Health (Scotland) Act 2015 strengthened measures in the Mental Health (Care and Treatment) (Scotland) Act 2003 that promote support for decision making, including those for independent advocacy, advance statements and named persons. We are implementing the 2015 Act with most provisions coming into force early Summer 2017 and we are looking at ways to further promote rights-based practice under the 2003 Act

During the Bill process for the Mental Health (Scotland) Act 2015, the Scottish Government committed to undertake 3 reviews, all of which will commence in 2017
