Implementing the new legislation

The following information will help you to implement the regulations and EU Procurement Directives for procurement exercises on or after 18 April 2016.

A co-ordinated approach has been taken in transposing the EU Directives into Scots law to ensure that a comprehensive suite of guidance could be produced to support the new legislation. The new regulations came into effect on 18 April 2016. The new suite of legislation is:

In addition to the regulations we have produced statutory guidance which describes how public bodies should support the ambitions of the Act. 

Guidance on the Living Wage was published as a separate document.

We encourage individual sectors and organisations to continue preparing to adapt their own internal procedures and processes and to consider what skills and development requirements will be necessary within their own organisations to prepare for the new rules. We will continue to provide regular national updates on implementation of the new rules.

Impact assessments

We used impact assessments to help shape and inform our work to implement the new legislation.

The Final Business and Regulatory Impact Assessment (BRIA) and the Final Equality Impact Assessment (EQIA) were published at the time the new legislation was laid before Parliament earlier this year.
