The Reservoirs (Scotland) Regulations 2016

These Regulations consolidate and replace (with some modifications for consistency) the provisions of the Reservoirs (Scotland) Regulations 2015. They make provision as to:

  • structures or areas which are not controlled reservoirs;
  • controlled reservoirs register: additional information;
  • information that a reservoir manager must register with SEPA;
  • time by which changes to information must be registered;
  • determination and charging of fees.
  • the review and appeal of a risk designation of controlled reservoirs;
  • applications for appointment;
  • fees in connection with applications for membership of panels; and
  • applications for review of decisions to appoint or remove panel members etc.

They also make provision in relation to the form and content of notices, reports, certificates and records under the 2011 Act, dispute resolution, and connected matters.  The Regulations come into force on 1 April 2016 and can be found here.

The Reservoirs (Enforcement etc.) (Scotland) Order 2016

This Order confers powers on SEPA to enable it to enforce the requirements of the Reservoirs (Scotland) Act 2011. The Order came into force on 1 April 2016 and a copy can be found here.

The Reservoirs (Disclosure of Information) (Scotland) Directions 2017

The Scottish Ministers have issued Directions to the Scottish Environment Protection Agency (SEPA) in exercise of powers conferred by section 104 of the Reservoirs (Scotland) Act 2011. The Directions came into force on 1st April 2017. The Directions can be viewed here.

The Reservoirs (Panels of Reservoir Engineers: Sections under which members may be Appointed)(Scotland)Order 2015 

The Reservoirs (Panels of Reservoir Engineers: Sections under which Members may be Appointed)(Scotland) Order 2015 came into force on 1 April 2015 and specifies the sections of the Act under which a member of a panel may be appointed.  

The Reservoirs (Scotland) Regulations 2015

These Regulations made provision concerning reservoirs under Part 1 of the Reservoirs (Scotland) Act 2011.  The Regulations came into force on 1 April 2015 and can be found here.  They were superseded by the Reservoirs (Scotland) Regulations 2016 - see above.

The Reservoirs (Scotland) Amendment Regulations 2015

The Regulations amended the Reservoirs (Scotland) Regulations 2015 to make further provision in relation to the review and appeals of a risk designation of controlled reservoirs and to clarify various provisions of the 2015 Regulations.  The Regulations came into force on 1 October 2015 and can be found here.  They were superseded by the Reservoirs (Scotland) Regulations 2016 - see above.

Reservoirs (Scotland) Act 2011 (Restrictions on Disclosure of Information in relation to national security.) Order 2015 

The Secretary of State has made the Reservoirs (Scotland) Act 2011 (Restrictions on Disclosure of Information in relation to National Security etc.) Order 2015, which provides for the making of non-disclosure and non-publication notices.
