Supporting guidance has been developed to assist property factors with their application for registration:
A Frequently Asked Questions document was prepared prior to the Act coming into force. It includes information to assist a potential applicant to decide if they are acting as a property factor as per the requirements of the Act.
The Property Factors (Scotland) Act 2011 - Guide to Registration sets out the steps to complete an application. It includes step-by-step notes on completing the online forms.
As part of the application process, and in line with section 3(2)(e) of the Property Factors (Scotland) Act 2011, you will be requested to specify any dwelling houses, flats or land in relation to which you act as property factor. There is an option to use a bulk upload mechanism to supply your lists of properties and/or land in the online registration system. To use this option, the Property/Land Portfolio - Bulk Upload File Specification sets out the required format for supplying these lists.
The annual update guide sets out the steps to be taken by property factors when completing the annual update of property and land records.
Code of Conduct
A code of conduct for property factors is published.
Since 1 October 2012, all registered property factors in Scotland have been statutorily obliged to adhere to the code of conduct and to put in place any necessary processes or alter existing practices in order to comply. Development of the code was supported by a 12-week public consultation during the autumn of 2011. Various documents relating to the public consultation and its responses are available for information:
