Executive Summary

Scotland's Freedom of Information legislation can be extended to organisations that appear to Scottish Ministers to exercise functions of a public nature or which provide, under a contract with a Scottish public authority, a service which is a function of that authority.

The legislation has previously been extended to bodies including arm's length organisations and private prison contractors.

As part of its incremental approach to extending coverage of the Freedom of Information (Scotland) Act 2002 (FOISA) the Scottish Government has consulted on extending FOISA to Registered Social Landlords.
