Study to provide robust evidence base which would assist Scottish Ministers in coming to a view as to whether legislation on the operation of pub companies in Scotland needs to be introduced, and if so, where the parameters of that legislation should apply.

Executive Summary

The last few decades have seen radical changes in the GB pub industry, with the trade facing a wide range of social, economic and regulatory pressures. As a result, there has been a significant contraction in the size of the industry in the UK over the last 30 years.

Legislative activity in England & Wales (i.e. through the introduction of a Market Rent Option) promoted requests to the Scottish Government from part of the industry to evaluate the Tied pub sector in Scotland.

A study was commissioned by Scottish Government to provide robust evidence base which would assist Ministers in coming to a view as to whether legislation on the operation of pub companies in Scotland needs to be introduced. The evidence base study was to evaluate whether any part of the pub sector is unfairly disadvantaged compared to others.
