Executive Summary

This consultation seeks views on draft regulations on the transfer of functions and members of the private rented housing panel (prhp) and homeowner housing panel (hohp)and their relevant committees to the Scottish Tribunals.

 

The draft regulations provide for the transfer of functions, transitional arrangements, consequential amendments and repeals and the transfer of the President and members of the prhp/hohp to the First-tier Tribunal.

 

The consultation also seeks views on draft regulations that determine the composition of the First-tier and Upper tribunal for Scotland when hearing cases in and from the housing and property chamber.

 

The draft regulations propose that the First-tier Tribunal when convened to hear housing and property cases will be composed of a legal member alone, a legal member with one ordinary member or a legal member with two ordinary members.

 

For appeals from the First-tier Tribunal Housing and Property Chamber the draft regulations propose that these will be heard by a full time sheriff in the Upper Tribunal. The draft regulations also proposes that the President of the Scottish Tribunals has the right to choose the Chamber President of the Housing and Property Chamber to sit in the Upper Tribunal should they consider that there is a particular expertise required to hear a case.
