Part 1 of the Housing (Scotland) Act 2006 introduced (from April 2009) powers for local authorities to issue maintenance orders where owners have not maintained, or are unlikely to maintain, their house to a reasonable standard. A maintenance order requires the owner to submit a maintenance plan. Local authorities have new powers (introduced in April 2015) to pay missing
shares towards costs approved under the Tenements (Scotland) Act 2004. The guidance explains these powers and provides advice on their use and enforcement, including rights of appeal and recovery of costs.
