The Scottish Government intends to introduce a statory requirement on organisations providing health and social care to have arrangements in place to demonstrate their committment to disclose instances of physical or psychological harm.

Executive Summary

The Statutory Duty of Candour would apply to health and social care services provided by NHS Boards, Local Authorities, all organisations providing services regulated by the Care Inspectorate, independant hospitals, independant hospices, General Practices, community pharmacies, dental practices and otometry practices. As this is an organisation duty, it would not apply to individuals providing services, for example childmiders.

The Statutory duty will require that an organisation must act in an open and transparent way with people when things go wrong. It will outline the minimum requirements that must be in place to support the duty of candour and require that reports are made to describe the implemetation arrangements.
