The proposals outlined in this consultation will deliver a simpler legislative framework which will enable SEPA to focus greatest effort on the environmental problems that matter most. It will provide a more consistent range of enforcement tools so that, proportionate and effective action can be taken against those who would damage the environment.

Executive Summary

This consultation builds on the direction and findings of SEPA’s Better Environmental Regulation consultation carried out last year and asks for your views on:

• Changes to the structure of environmental protection legislation in order to create a new, integrated framework for the permissions (licences, permits, rules etc) which SEPA uses to control activities which could harm the environment.

• Changes to the enforcement tools (sanctions such as fines or enforcement undertakings) which SEPA uses to deter non-compliance. Our aim is to bring forward a more joined-up and flexible range of sanctions to reflect the more joined-up framework for permissioning and to provide a balance to the more proportionate, risk-based approach which SEPA will take.
