CRIMINAL PROCEDURE ( SCOTLAND ) ACT 1995 (AS AMENDED)
AVAILABILITY OF DRUG TREATMENT AND TESTING ORDERS
1. The purpose of this Circular is to notify the High Court, Sheriff Courts and others of the forthcoming availability of Drug Treatment and Testing Orders (DTTOs) in respect of individuals resident within the sheriff court districts of Dunoon and Rothesay .
2. Legislation for DTTOs is contained in the Criminal Procedure (Scotland) Act 1995, as amended by Sections 89-95 and Schedule 6 of the Crime and Disorder Act 1998 . In addition, section 47 of the Criminal Justice (Scotland) Act 2003 provides for remote monitoring as a condition of a DTTO .
3. It should be noted that as of Tuesday 2 April 2006, arrangements exist to allow a Drug Treatment and Testing Order to be made for offenders normally resident within the sheriff court districts of Dunoon and Rothesay .
